Pervez Musharraf is the latest example of the power tussle going on between the high ranks of Pakistan Army – One “Gang” of corps commanders controlled by Major General Sarfaraz Sattar who controls the “Rawalpindi Gang” and the other “Gang” of corps commanders controlled by the “Bajwa Gang”.

Judgement of the Special Court giving death sentence to “Mohajir” Pervez Musharraf came as a surprise to many people. Pakistani courts that cannot convict Globally Designated Terrorist Rao Anwar and cannot release political prisoners like Rana Sanaullah, Ex-PM Shahid Khakhan Abbasi etc., has given death penalty to an Ex-Army Chief General Pervez Musharraf . This is a clear case of Sarfaraz Gang gaining upper hand over Bajwa Group.

Death Sentence

A three-member special court in Islamabad on Tuesday 17-December 2019 convicted Ex-Army Chief General Pervez Musharraf of violating the constitution by unlawfully declaring emergency rule while he was in power, in a case that had been pending since 2013.

The 76-year-old former leader, who has lived in self-imposed exile in Dubai in the United Arab Emirates for more than three years, has the option to appeal the verdict.

The army’s involvement in the Kargil conflict in May 1999 caused a major rift between him and then- Punjabi Prime Minister Nawaz Sharif, and the army general seized power in a coup in 1999.

In November 2007, Gen Musharraf suspended the constitution and imposed emergency rule – a move which sparked protests as General Pervez Musharraf was a Mohajir (considered as third class Citizens in Pakistan and also sometimes abused as Kafirs) and the Pakjabi power class could not tolerate to be ruled by a third class Ethnic General. He resigned in 2008 to avoid the threat of impeachment.

When Nawaz Sharif – an old rival whom he deposed in the 1999 coup – was elected prime minister in 2013, he initiated a treason trial against General Musharraf and in March 2014 the former general was charged for high treason. He was indicted in 2014 on a total of five charges, including three counts of subverting, suspending and changing the country’s constitution, firing Pakistan’s chief justice, and imposing emergency rule.

It’s the first time in Pakistan’s history that an army chief has been tried and found guilty of treason. Under Pakistan’s constitution, high treason is a crime that carries the death penalty or life imprisonment.

The special court ruled on the death sentence by a two to one majority, with one of the three judges not backing the death sentence but agreeing on a conviction.

Ex-Army Chief General Pervez Musharraf has been living in Dubai since 2016 after Pakistan’s Supreme Court lifted a travel ban allowing him to leave the country to seek medical treatment. From his hospital bed in Dubai earlier this month, the former leader said in a video statement that he was innocent and the treason case was “baseless.”

Court cases

Musharraf earlier went into exile in 2008, returning to Pakistan in 2013 with the aim of running in the country’s national elections. But his plans unraveled as he became entangled in a web of court cases relating to his time in power.

In 2007, Musharraf declared a state of emergency, suspended Pakistan’s constitution, replaced the chief judge and blacked out independent TV outlets.

Musharraf said he did so to stabilize the country and to fight rising Islamist extremism. The action drew sharp criticism from the United States and democracy advocates. Pakistanis openly called for his removal.

Under pressure from the West, Musharraf later lifted the state of emergency and called elections in which his party fared badly.

Musharraf stepped down in August 2008 after the governing coalition began taking steps to impeach him. Prosecutors say Musharraf violated Pakistan’s constitution by imposing the state of emergency.

Pakistan Army Reaction

The indictment of Ex-Army Chief General Pervez Musharraf in 2014 for treason was a highly significant moment in a country where the military has held sway for much of its independent history.

Many of Pakistan’s army chiefs have either ruled the country directly after coups, as Gen Musharraf did, or wielded significant influence over policy making during periods of civilian rule.

But Ex-Army Chief General Pervez Musharraf was the first army chief to be charged with such a crime and the powerful military have watched the case carefully.

Analysts say the institution is deeply aware that how the case proceeds could set a precedent.

Many expect the judgement to be delayed by an appeal by Gen Musharraf’s lawyers and it unclear if a request to have him returned would be successful as there is no formal extradition treaty between Pakistan and the UAE.

In a Tuesday 17-December 2019 statement, the media wing of the Pakistan Armed Forces said the special court’s sentence had been received “with a lot of pain and anguish.”

Pakistan’s Inter-Services Public Relations (ISPR) said that Musharraf “can surely never be a traitor” and that he had served the country for over 40 years.

“The due legal process seems to have been ignored including (the) constitution of special court, (the) denial of fundamental right of self-defense, undertaking individual specific proceedings and concluding the case in haste,” the statement said.

It added that the Armed Forces of Pakistan “expect that justice will be dispensed in line with the Constitution of Islamic Republic.”

Attorney General of Pakistan Press Conference

Attorney-General for Pakistan Anwar Mansoor Khan on Tuesday said the high treason case against former president retired Gen Pervez Musharraf had been “void from the beginning” and questioned “what the rush was” in pronouncing the judgment — the death penalty — which was given in absentia.

Attorney-General Khan’s remarks came during a press conference held in Islamabad late Tuesday night alongside the government’s chief spokesperson Firdous Ashiq Awan.

A special court had earlier in the day sentenced to death the former military ruler who has been in self-imposed exile since 2016.

“A trial in absentia is not a routine matter,” he said. ⠀⠀⠀⠀⠀⠀ “[Musharraf] was not given a chance to record his statement under Section 342 (of the Constitution) or to produce his witnesses.

“Every person is guaranteed a fair trial under Article 10-A of the Constitution,” said the attorney-general, adding: “A trial should not just be fair but must also be seen to be fair.”

He said this (PTI-led) government has the viewpoint where it believes every person, no matter their misdeeds, must be provided justice.

“The government will stand up against injustice when it sees an accused is not provided justice. Injustice is a curse for the country.

“This is what constitutional deviation is. When judgments are given against the Constitution.

“What else can we call such a judgment where a mandatory requirement, a person’s fundamental right under Article 10-A, is deviated from?” said AG Khan.

Further criticising the verdict, the attorney-general said that the courts had operated “outside the scope of the law”.

“If the courts are independent and free, this does not mean that they decide a verdict outside the scope of the law. It does not mean they do not give a person their fundamental right. And most importantly, if a person is not allowed to produce evidence, there can be no more injustice committed against the person than what we have witnessed in this case.”

When reminded that PM Imran had said that Musharraf be hanged under Article 6 of the Constitution, Awan said that the prime minister had always fought for the rule of law and “justice for all”.

“Our sole concern is that justice must be provided […] where justice is not provided in its true spirit, to extend reservations and to fight for the rule of law is the manifesto of the Pakistan Tehreek-i-Insaf — and we will continue to uphold it,” she said.

AG Khan said that a violation of the Constitution does merit punishment “and there is no ambiguity in the matter”. He, however, highlighted that a person cannot be sentenced when he is not accorded his right of audience, right of producing evidence and right to a fair trial.

“A trial is a crucial aspect of any case. Maybe evidence to the contrary would have emerged,” he added.

‘Legal aspects’

Before commenting on the matter, the attorney-general had warned the media that it must be considered that he is not speaking in favour of a particular individual or supporting anyone. “I am only going to speak of the legal aspects of the case.”

Attorney-General Khan recalled that Musharraf was in Pakistan when the charges against him were announced and had filed some petitions requesting that others involved in the decision to impose an emergency also be made a party to the case.

Attorney-General AG Khan said that following the 18th Amendment, in which Article 90 was modified, the president was no longer given the authority by the federal government to file a complaint.

“Because he could not file a complaint, the action taken against Musharraf was void from the beginning and could not have been carried out lawfully.”

“Musharraf is bed-ridden and is in the ICU at a hospital. So this is another major issue: when you know a person is hospitalised, in his absence was it right to announce this judgment or not?” he said, as he continued to explore the legality of the verdict.

Court Rejections

He said that the government wished to change its team at one point in the case, so that “mistakes made by the past governments” could be rectified. “[The previous] team was not ready to make those changes.”

He said when the team was swapped out, the court reacted very strongly and issued immediate directives to get the case moving, “irrespective of the situation”.

Attorney-General Khan said that the last team had filed “written arguments after its removal” and the court based their decision on those arguments.

“When the case was fixed, the additional attorney-general was sent by me to argue the case, but the court sat him down saying, ‘You have not been appointed by the federal government’ whereas an additional attorney-general is an appointed officer under the law.

“Despite that, the court refused to listen to him and said a new team of senior lawyers must be formed,” said AG Khan.

He said the new team had requested the court for some time to study the case as they had just been appointed but “the court refused and told them to argue or the verdict will be announced”.

Expanding on what constitutes a fair trial, AG Khan said that the court was requested to allow the video statement of the accused to be recorded. “The court said you must bring him to Pakistan or else we will not record a statement.”

The attorney-general said entire hearings had been held via video link and that many people had recorded their statements from abroad in various cases in the past.

“When it came to [Musharraf] and when the court was told he was unable to travel, the court refused the request,” he said, adding that a request for a commission to be formed to go take his statement was also rejected by the court.

“When the lawyers wished to record evidence, that too was refused. When Chaudhry Shujaat expressed willingness to be made a party to the case, that, again, was refused.”

AG Khan said various applications were also submitted requesting that various generals and bureaucrats be made a party to the case, but they, too, were rejected by the court.

“Whenever a conspiracy is hatched, it is an action undertaken by multiple people. And if this was a conspiracy, it could only be proved in the presence of the others.

“If they were not present this means it was a directed, personal attack or action against one person.”

Death Sentence is Given because Musharraf was a Mohajir.

Many people in Pakistan are of the opinion that the death sentence awarded to Pakistan by the special court as the puppet of the Punjabi Army Group of Major General Sarfaraz Gang because Musharraf was a Ethnic Minority Group of Mohajir who are considered as Third Class Citizens and no one can rule Pakistan except the Pakistan. As per people this death sentence is to send a clear message to the present Pakistan Army General Bajwa (known for his relation to Ahamadiya who are considered Non-Muslims and hence Kafirs) that next in line can be General Bajwa himself and he will also meet the same fate.

Mohajir Leader Altaf Hussain who is regarded as the “New Nelson Mandela” by Mohajirs and who is the proponent of the Independence of Mohjairs and Sindhis and forming a new Independent nation “Sindhu Mahadesh” came down heavily on Pakistan establishment. In a series of tweets he lambasted Pakistan.

He tweeted on Twitter, “Article 6 case :First time in the history of Pakistan an Ex-Army chief was sentenced to capital punishment. Only because he is a Mohajir. All Punjabi aiders abetters, collaborators Generals of the Coup and legitimising the coup by CJSC are exempted from Capital punishment.”

He further said, “There were three Army Generals on the ground who were central figures in staging the coup against Sharif’s government.

He further Tweeted, “All Punjabi Aiders, Abetters, legitimisers oath takers under PCO (Provisional Constitutional Order) are free from any charges in General Pervez Musharraf case. It this Justice or is it mockery of Justice!”

Another reputed Mohajir leader, Arif Aajakia also in his video message on his YouTube channel lambasted Pakistan Army. He said no one can touch Pakistan Army. This judgment is given by a small special court and there are a lot of courts thereafter for appeals. He said all the benefits from Musharraf’s Coup were taken by Punjabi Generals of Pakistan Army and Fauji Foundation. He questioned Pakistan Judiciary, why the Punjabi Generals who were on the ground in the Coup were not given Death Sentence. Why a Mohajir General Musharraf was made a scapegoat. He said the budget of whole Karachi which is the Financial Capital of Pakistan has a total budget of 2.5 Million PKR whereas the total budget of a small district in Sindh “Larkana” is 20 Million PKR whereas there is not a single good road in Larkana. He said all the money is swindled by Punjabi Army and its boot lickers Sindhi Jagirdaars (Landlords).

He also exposed the two Gangs in Pakistan army as we mentioned above – The “Sarfaraz Gang” and the “Bajwa Gang” and their power tussle behind Ex-Army Chief General Pervez Musharraf death penalty. He exposed that the Pakistan Prime Minister Imran Khan, who is a mere puppet, is supported by the Sarfaraz Gang while Bajwa Gang is supported by DG ISPR Asif Gafoor. He said because of this power tussle between the two Gangs, Imran Khan or the courts that have no power and are useless, were used to give this verdict as a show of power by the Sarfaraz Gang.

He further said that the Gafoor statement is final that Musharraf worked for 40 years in Army fight all the impotent wars including the proxy war waged against India, training Terrorists and infiltrating terrorists in India to kill innocent civilians including women and children, attempt to capture Indian territory in Kargil and losing that conflict as well.

Ex-Army Chief General Pervez Musharraf is not convicted for 40 Years of service but for demolition of Constitution.

However Ashfaq Parvez Kayani (October 2004 – October 2007) is not implicated even though he was the ISI head under Pervez Musharraf, just because he was a Punjabi.

The whole Pakistan supported him when he tried to repeat Kargil(though he was let down by the Pakistani Army which was incapable to achieve that simple a target), the whole Punjabi community cheered when he killed Nawab Akbar Bugti and during the War on Terror; it supported him wholeheartedly when he toppled Nawaz Sharif and became the President but Pakistan finally proved that a Muhajir is a Muhajir and your achievements will never count.

In fact, this would remind one of another famous Muhajir who was the only one indicted in the case – Abdul Qadir Khan. Who are all those Punjabis who were involved in the smuggling ring with him, will we ever know?

This is a wake up call for all those who believed in the idea of Pakistan. What sort of a country glorifies a global terrorist like Maulana Masood Azhar but does everything to undermine the achievement of one of their most successful leaders – just because of their race?
